What Do You Do If an IRS Tax Lien Has Expired But Is Still on a Deed?

The Internal Revenue Code establishes the rights that the Internal Revenue Service has against taxpayers who fail to pay their income taxes. The IRS typically has three years to assess income taxes after taxpayers file their tax returns. The IRS has 10 years to collect judgments against taxpayers after the original lien filing date.

    • A delinquent taxpayer first receives a Notice and Demand for Payment from the IRS. Within 10 days, the taxpayer must resolve the tax delinquency or formally request an offer in compromise or installment agreement from the IRS. After 10 days, the IRS has the right to file a Notice of Federal Tax Lien.
